Court Dismisses Ann Altman's Abuse Lawsuit Against Sam Altman With Prejudice

A federal court has closed the door on a lawsuit that drew significant public attention to OpenAI CEO Sam Altman's personal life. US District Judge Zachary Bluestone dismissed the case with prejudice on Tuesday, meaning Ann Altman cannot refile the same claims in that court.

What the Case Was About

Ann Altman filed the lawsuit last year, alleging that her brother Sam had sexually abused her repeatedly throughout their childhood. The allegations were serious and, at the time, generated considerable coverage given Sam Altman's profile as the head of one of the most closely watched companies in tech. According to The Verge, the dismissal came not on the merits of those allegations but because of procedural failures on Ann's part over the course of the litigation.

Why the Judge Dismissed It

Judge Bluestone's reasoning was procedural rather than substantive. According to court records, Ann Altman failed to appear for an independent medical examination and missed other court-mandated deadlines over the past year. The judge had reportedly issued warnings that continued non-compliance would result in dismissal. When those deadlines still weren't met, the court granted Sam Altman's motion to dismiss.

It's worth being clear about what this means and what it doesn't: a dismissal for procedural reasons is not a ruling that the allegations were false or that the defendant was innocent. It simply means the case didn't move forward through the legal process as required.

Sam Altman's Side

When the lawsuit was originally filed, Sam Altman's family responded firmly. A joint statement from Sam, his mother, and his brothers described Ann's claims as "deeply hurtful and entirely untrue," adding that "all of these claims are utterly untrue" and that the situation caused "immense pain" to the family. Sam Altman has consistently denied the allegations.

The judge denied Sam Altman's request for attorney fees and costs, which means Ann Altman will not be penalized financially beyond the dismissal itself.

Ann Altman's Legal Representation

Adding another layer of complexity, Ann Altman's attorney, Santos Perez, withdrew from the case earlier this month. In a statement to The Guardian, Perez said he was "no longer authorized to comment on this case" but added, "I continue to believe in Annie." That comment, brief as it is, suggests the withdrawal wasn't simply a routine professional decision — though without more detail, it's hard to read too much into it.

The Bigger Picture for Sam Altman

For Sam Altman, the dismissal removes one significant distraction from his public role. He's been navigating a crowded stretch professionally — from discussions around a potential OpenAI IPO to questions about AI safety and development timelines. He's also faced scrutiny from outside the tech world — Betty Gilpin notably mentioned his name at the Emmys in a less-than-flattering context.

None of that means the underlying questions raised by Ann Altman's lawsuit simply disappear. A dismissal with prejudice ends the legal proceeding, but it doesn't erase the public record of what was alleged. For anyone following this story, that distinction matters.
